1. Definitions
For clarity, the following terms are used throughout these Terms:
Academy / We / Us: Doctor Yilmaz Academy, the provider of the Platform and training services.
You / User: the individual physician accessing or using the Platform.
Platform: the online environment where courses, videos, materials, and account functions are provided.
Content: all educational materials (videos, text, slides, images, assignments, demonstrations, etc.).
Hands-on Training: in-person supervised training sessions or workshops offered by the Academy.
2. Eligibility and verification
The Platform is available exclusively to licensed physicians (including BIG-registered physicians in the Netherlands, or physicians holding an equivalent valid license in another jurisdiction).
- You must be legally authorized to practice medicine in your jurisdiction.
- You must provide accurate registration and licensing information when requested.
- We may verify eligibility and may suspend or deny access if eligibility cannot be confirmed.
If you are not a licensed physician, you must not access the Platform. Any access obtained via false information may be revoked immediately.
3. Account security and permitted use
Your account is personal and may be used only by you. You are responsible for safeguarding your login credentials and for all activity under your account.
- No sharing: you may not share, transfer, sublicense, or otherwise permit third parties to use your account.
- Security: you must promptly notify us of suspected unauthorized use or security incidents.
- Accuracy: you must keep your account details accurate and up to date.
We may implement security measures (e.g., device/session controls) to protect content and prevent unauthorized access.
4. Educational scope; no patient care
The Platform provides postgraduate medical education and professional training only. The Academy does not provide clinical services through the Platform.
- No diagnosis, treatment recommendation, or patient-specific medical advice is provided.
- No physician–patient relationship is created between the Academy and any user or third party.
- Content does not replace guidelines, institutional protocols, formal training, or clinical judgment.
5. Professional responsibility (clinical liability stays with you)
You remain fully and exclusively responsible for your clinical decisions and patient care, including (without limitation):
- indications, patient selection, and informed consent;
- technique selection, dosages/materials, and procedural execution;
- complication management, aftercare, and follow-up;
- compliance with laws, professional standards, and local regulations.
Participation in online courses or hands-on training does not transfer, reduce, or share medical, civil, disciplinary, or criminal liability.
6. Online access, availability, and “lifetime” access
Online course access is provided on a digital basis and may include streaming and/or downloadable materials (where enabled). While we aim for high availability, uninterrupted access cannot be guaranteed.
- Platform lifetime: where stated as “lifetime access,” this means access for as long as the Platform (or the specific course offering) remains operational and available.
- Service changes: we may update, improve, replace, or retire features or content for educational, legal, technical, or quality reasons.
- Technical limits: access may be affected by maintenance, security incidents, provider outages, or force majeure.
“Lifetime access” is not a guarantee of perpetual availability in every circumstance (e.g., discontinuation, regulatory changes, security issues, or force majeure). It is a practical access policy tied to the continued existence of the Platform.
7. Hands-on training terms
Hands-on Training is provided as supervised education. Supervision supports learning but does not constitute clinical oversight or transfer of responsibility.
- Conduct: you must follow faculty instructions, safety standards, and facility rules.
- Competence: you must work within your scope and training level and disclose relevant limitations when asked.
- Safety: we may remove participants from training where safety, professionalism, or compliance is compromised.
Any separate course-specific terms (e.g., schedule, prerequisites, materials) apply in addition to these Terms.
8. Fees, payment, cancellations, and refunds
Fees (where applicable) are stated at the time of purchase or enrollment. Payment terms, VAT handling, and invoicing follow the checkout flow and applicable law.
- Digital content: by purchasing immediate access to digital content, you acknowledge that delivery begins immediately after payment (where enabled). Statutory withdrawal rights may be limited once performance begins, to the extent permitted by law.
- Hands-on training: cancellation and rescheduling rules depend on the specific training offering and will be stated during booking (including deadlines and any administrative fees).
- No misuse refunds: access terminated due to account sharing, fraud, or serious breach may be non-refundable.
If you want stricter commercial terms (recommended), publish a dedicated Refund & Cancellation Policy page and link it here. Otherwise, your checkout terms must clearly state the applicable rules per product/training.
9. Intellectual property and content rules
All Content is protected by intellectual property laws and remains the exclusive property of the Academy and/or its licensors. You receive a limited, non-exclusive, non-transferable license to access and use Content for your personal professional education.
- No copying, recording, screen-capturing, redistributing, uploading, selling, sublicensing, or public display of Content.
- No sharing of course files, login credentials, or restricted materials with colleagues, clinics, or third parties.
- No use of Content to create competing training products, course libraries, or derivative publications without written permission.
10. Acceptable use and prohibited conduct
You must use the Platform lawfully and professionally. Prohibited conduct includes, without limitation:
- unauthorized access, account sharing, credential stuffing, or attempts to bypass paywalls or access controls;
- uploading malware, scraping Content, reverse engineering platform features, or disrupting service availability;
- posting unlawful, defamatory, discriminatory, or unprofessional material;
- misrepresenting your identity, license status, or professional credentials.
11. Confidentiality and patient data
You must not disclose identifiable patient information on the Platform. If discussions involve cases, you must anonymize data so individuals cannot be identified.
- Do not upload patient photos, documents, or recordings unless explicitly permitted by the Platform and fully compliant with applicable law and patient consent.
- You remain responsible for GDPR/medical confidentiality compliance within your jurisdiction.
Personal data processing on the Platform is described in our Privacy Policy.
12. Disclaimers and limitation of liability
The Platform and Content are provided “as is” for educational purposes. Medical science evolves; techniques and recommendations may change. You are responsible for verifying applicability, safety, and legality in your clinical setting.
To the maximum extent permitted by law, the Academy is not liable for indirect or consequential losses (including loss of profit, loss of reputation, or business interruption). The Academy does not accept liability for outcomes resulting from your clinical decisions, procedures, or patient management.
If you apply educational material incorrectly, outside competence, or contrary to guidelines or local regulations, responsibility lies with you—not with the Academy.
13. Indemnification
You agree to indemnify and hold harmless the Academy from claims, liabilities, damages, and expenses (including reasonable legal fees) arising from: (i) your breach of these Terms, (ii) misuse of the Platform or Content, or (iii) your clinical practice and patient care.
14. Suspension and termination
We may suspend or terminate access (with immediate effect where appropriate) if we reasonably believe that:
- you are not eligible (not a licensed physician or license cannot be verified);
- your account is shared or accessed by unauthorized parties;
- you breach these Terms or engage in prohibited conduct;
- security, legal, or compliance reasons require action.
Termination may result in loss of access to Content. Where required by law, we will apply proportionate measures and provide reasoning.
15. Changes to the Platform and Terms
We may update the Platform and these Terms to reflect operational, technical, educational, or legal changes. Updates become effective upon publication on this page, unless stated otherwise.
Continued use of the Platform after changes constitutes acceptance of the updated Terms.
16. Complaints handling
If you have a complaint related to Academy services, please contact us first so we can attempt to resolve it promptly. Where applicable under Dutch frameworks, complaints may be handled via Klachtenportaalzorg.
